Step 1: Plea & Entry into Non-Adjudication Program
- Defendant enters a guilty plea
- Defendant signs the Non-Adjudication Order and Waiver
- Judge withholds acceptance of the guilty plea and allows entry into the DUI Non-Adjudication Program
- Clerk sets a compliance date (deadline for completion of all requirements)
At this stage, the case is “Pending Non-Adjudication”.
Step 2: Clerk’s Initial Reporting to DPS (Within 5 Days)
The clerk must submit the following to Driver Services:
- Abstract of Court Record
- Certified copy of the Non-Adjudication Order
- Certified copy of the Commissioner’s Ticket
This step ensures:
The defendant’s driver record reflects a pending non-adjudication status
Step 3: Compliance Period
During this period, the defendant must complete all required conditions, which may include:
- MASEP
- Payment of fines and assessments
- Any additional court-ordered conditions
Step 4: Final Order of Non-Adjudication
- Judge reviews the case status and completion of all requirements
- Judge signs a Final Order of Non-Adjudication
Step 5: Clerk’s Final Reporting to DPS
The clerk must submit:
- Certified copy of the Final Order of Non-Adjudication
- Updated Abstract of Court Record
DPS will then update:
- The driver record
- The Non-Adjudication Registry (SONAR)
At this point, the DUI is officially non-adjudicated and eligible to appear in SONAR (for Mississippi license holders).
Step 6: Criminal History Reporting (CIC / ATN)
On the criminal history side:
- Clerk submits the disposition to CIC (using the ATN sheet or a court abstract that includes the ATN. (more on ATN and disposition reporting here)
- Criminal history now reflects the disposition as Non-Adjudication
Step 7: Expungement Option
After successful completion the defendant may file a Petition for Expungement.
If granted, the case is removed from public record in accordance with statute.
